LMS Tours Terms and Conditions



TERMS AND CONDITIONS & LMS TOURS

These terms and conditions forms part of the official entry into an Event. By entering and/or participating in the Event you consent to these terms and conditions. Entrant further confirms and warrants that all Participants are aware of the terms and conditions contained herein.

Terms and conditions of play:- 

1.) RULES & POINT SYSTEMS

The standard LastManStands.com rules and game point system will apply to the Event, unless specified otherwise. All teams participating in any Event must wear official LMS Shirts.

2.) TEAM ELIGIBILITY

Team eligibility shall vary according to Event and at the discretion of the Organiser. Events are open to all Teams unless Team eligibility is specifically limited by the Organiser for a specific Event. For clarity on Team eligibility at a specific Event please email simon@lasmanstands.com.

Squads entering any LMS Tour Event are limited to 12 players.

3.) PLAYER ELIGIBILITY

Open Events are open to all players unless player eligibility is specifically limited by the Organiser for a specific Event. Player Eligibility shall vary according to Event and at the discretion of the Organiser. For clarity on eligibility at a specific Event please email lmstours@lasmanstands.net. Current professional players however are excluded from participating at any Event. Should a professional player wish to enter or participate in an Event then in such instance clearance would need to be sought from the Organiser.If you are unsure if a player is deemed professional please email tours@lastmanstands.net to get clearance.

Particular attention is drawn to player eligibility at a World Championships Event:-

In order for a player to be eligible to enter World Championships, they are required to satisfy the eligibility criteria below:

  • Played a minimum of 4 LMS league games for the Team.
  • Player's cannot be contracted to their countries cricketing governing body  eg. ECB, CSA, CA, BCCI, PCB etc. at any time in the year 2017.

In order for a player to be eligible to enter Cow Corner Cup, they are required to satisfy the eligibility criteria below:

  • Played a minimum of 2 LMS league games for the Team.
  • Player's cannot be contracted to their countries cricketing governing body  eg. ECB, CSA, BCCI CA, PCB etc. at any time in the year 2017.

LMS Tours reserves the right to issue special dispensation to certain player's who are unable to meet the above.

4.) TEAM SQUAD

All players must be registered on the Last Man Stands website before an Event takes place.

All Players and teams shall meet the criteria detailed above.

Players cannot play in more than one team during an Event unless the Organiser consents to same. Should the Organiser consent to same then any such players assisting other teams shall be deemed a ringer and will not be allowed to bowl more than 2 overs and bat higher than 5.

5.) MATCH DAY TEAM

The Match Day Team must consist of eligible players.

During the Event there may be a valid reason why a Team does not meet the criteria set out above (Clauses 3 and 4). Special dispensation may be granted by the Organiser, depending on the situation. If a team finds itself in a situation where they are short of eligible players for a match, Entrant or representative is to approach the Organiser for a ruling. Approaches must be in writing unless Organiser agrees otherwise. The Organiser will analyse the situation and advise Entrant on its decision, which decision shall be final and binding. 

6.) EVENT STRUCTURE & DATES

The Event including but not limited to group structures, prizes, team count, venues and dates may vary at the Organiser's sole discretion. Any variation may not be construed as a basis for return of entry fee, unless the Organiser agrees otherwise.

10.)CLOTHING

All Teams may only play in the official Last Man Stands clothing. The Last Man Stands logos as well as any sponsors logos are trademarked property and may not be reproduced without written permission.Teams may be permitted to have their team names and sponsor's logo's placed onto the shirts, however written approval is required from the Organiser. The Organiser reserves the right to decline any team sponsors's logo's to be placed on the clothing. The Organiser reserves the right to decide where team sponsor's logos are placed 

11.) Prizes

All Vouchers may be withdrawn/cancelled by LMS Tours at its sole discretion and at any stage should a Team to which it was awarded be found to have to have cheated and/or be found to have attempted to manipulate any LMS Tour Event or a have conducted themselves in such a manner as to contravene the Player Code of Conduct of Last Man Stands.

Prizes are not redeemable and cannot be transferred for cash or another other form/transferred to any other teams/persons nor is there any refund value.

MEDIA

The Organiser has exclusive rights to all media at the Event.

All Participants and Teams must make themselves available before and after their matches for brief media interviews.

All photographers are to remain off the playing field at all times. Any encroachment will result in a fine of up to GBP5000.00.

All media will need to be accredited with theevent and adhere to the event terms and conditions.

13.) LIMITATIONS OF LIABILITY

The Team agrees to participate in the Event and have read and understood the Rules and Regulations of the event and all that it entails. The Entrant confirms that he/she/it is authorised by the Team to declare that the Team agrees to abide by the Rules and Regulations contained at  http://www.lastmanstands.com/termsandconditionslastmanstands and any ruling made from time to time by the Organisers as well as the terms and conditions contained herein. In the event that there is a contradiction between the Rules and Regulations and the terms and conditions contained herein, then these terms and conditions shall apply. The Team acknowledges and accepts that cricket can be a dangerous sport and that accidents causing death, bodily injury, disability, loss or damage, including property damage, can occur. The Entrant, as well as each and every participant, accept these risks. By participating in the Event, the Entrant, hereby irrevocably indemnifies and keeps indemnified the Organiser, its franchises, directors, employees and third party agents against all loss (consequential or otherwise), damage, injury and or death, costs including legal costs, interest and expenses which the Organiser, its franchises, directors, employees and third party agents may hereafter be held liable for, pay, incur or sustain in connection with any action, proceedings or claim being instituted against it by any party whomsoever, including the legal guardian of the minor child, directly or indirectly arising from or related to the use of all the Event facilities in respect of all Participants involved in the Team including all minors. The Organiser will not be held liable for any injuries or damages (consequential or otherwise) that occurs to you, or your Team, your property or that of a 3rd party during the Event. Look after yourselves and each other.

 

The Entrant accepts responsibility for the proper conduct for the Team whilst at the Event. If the Organiser or any other person in authority is of the reasonable opinion that you or any Participant is behaving in such a way as to cause or be likely to cause danger or upset to any other person or damage to property, Organiser will be entitled to terminate the Event of the Participant(s) concerned. The Participant(s) concerned will be required to leave the Event or other service and Organsiers will have no further responsibility to them. No refunds will be made and the Organiser will not pay any expenses or costs incurred as a result of the termination. Entrant will be responsible for making full payment for any damage or loss caused by you or any member of your party during Event period.

 

The Entrant, Participants and Organisers are independent contracting parties, and nothing contained in this agreement shall be deemed to create a partnership, joint venture or agency relationship between them, or grant any party any authority to assume or create any obligation on behalf of, or in the name of the other.

 

14) GENERAL TRAVEL

All members of the Team that stay within  accommodation including hotels arranged by LMS Tours shall provide damages deposits to the hotel on arrival. Should there be any additional charges incurred by the Team the Entrant shall ensure that payment of such additional costs are settled directly with the hotel failing which the Entrant will be responsible for meeting any claims subsequently made against LMS Tours (together with our own and the other party's full legal costs).

 

Should you be flying to the Event via the group booking offered by the Organiser, seating may be requested for your group however we cannot guarantee that all seats will be located together.

 

All payments made with respects to the Event, including but not limited to deposits, Event entrance fees, flights and/or hotels are non-refundable once payment has been made. Your entrance into the Event, flight and/or hotel shall only be deemed to be confirmed once full payment has been made. Failure to make payment in full on the agreed final date of payment or failure to pay deposits on time will mean cancellation of your Event entrance, flights and/or hotel booking. Prices may also vary according to increases in travel prices, taxes, Event costs or at the Organisers discretion. At this point you will be liable to settle any difference in pricing on demand. Any changes or amendments to bookings that can be accommodated are to be requested in writing. A reasonable admin fee will be levied by the Organiser if such change or amendment can be accommodated. Entrant shall ensure that all information supplied to the Organiser regarding his/her/it shall be true and correct for the purposes of travel. The Organiser shall not be liable for any cancellations or damages sustained as a result of incorrect travel information provided.

 

It is your responsibility to ensure that you and the Participants are in possession of all necessary travel and health documents before departure. The Organiser cannot accept any liability if you are refused entry onto any transport or into any country due to failure on your part to carry correct documentation. If failure to have any necessary travel or other documents results in fines, surcharges or other financial penalty being imposed on us, you will be responsible for reimbursing us accordingly. In the event the Organiser is asked to reissue tickets that have been lost, destroyed or stolen and we agree to do so, any charges incurred as a result of this will be payable by you. No refunds shall be provided should travel visas or the like  be refused. The onus is on the travelling party to ensure they obtain sufficient visas for travel.

 

15) INSURANCE AND EVENT CANCELLATION (Partial or full)

The Entrant/Participants and Team are solely responsible for travel, sport and entry insurance while travelling to and from as well as during the Event, including insurance covering partial/full cancellation of the Event due to any reason including acts of God. Remember that you need to make it clear to your insurance company that you will be partaking in a cricket event to ensure you get full protection including partial/full cancellation of the Event. In the unlikely event that we are forced to change/cancel/partially cancel or terminate the Event for any reason whatsoever, we regret we will be unable to make any refunds (unless we obtain any from our suppliers), pay you compensation or meet any costs or expenses you incur as a result (It is the Entrant/Participants responsibility to ensure they have sufficient insurance to cover any and all damages you suffer should the event for any reason be cancelled/changed or terminated).
LMS Tours will however endeavour to postpone any Events to a future date.

 

16.) GENERAL

The Entrant/ Participants and Team further consent to Organiser utilising any photographs, video footage or the like in its social media posts, marketing media or equivalent in perpetuity, across the world and without consideration.

The Organiser reserves the right to amend any of the aforementioned terms and conditions at any stage including the dates of the Event, its structure, fixtures, prizes and/or venue. It is the responsibility of the Entrant to ensure that he/she/it as well as the Team remains up to date with amendments.

 

Definitions:-

Event/Tournament shall mean: all general events run by LMS Tours or in conjunction with LMS Tours including an Open Event,  World Championships 2017 (Cow Corner cup or World Championships) or an event (Excluding a LMS league) where WCQP or CCCP are awarded.

Team shall mean: the team made up of Entrant and Participants or both competing in an Event.

Entrant shall mean: an individual or organisation, whether or not incorporated, entering a team in the Event and acting as in the scope as, inter alia, team captain/team organiser/team representative. 

Participants shall mean: all persons being part of the Entrants team, or acting within the Entrants knowledge, including players, managers, support persons, their respective officers, directors, employees, agents, contractors, sub-contractors and representatives. 

Organiser shall mean: LMS Tours including event sponsors, managers, coordinators, their respective officers, directors, employees, officials, stewards, observers, umpires, volunteers, agents, contractors, grounds and/or sub-contractors or representatives. 

Open Even shall mean: a World Championship Qualification Event or Cow Corner Cup Qualification Event where Prizes are awarded.

LMS Tours shall mean: LMS Tours Limited (Company No 9824561), a company registered in accordance with the Company Laws of England and Wales.

Prize shall mean: Either specific cash prize or other as determined by LMS

Venue shall mean: Venue where an Event is held.

World Championships shall mean: The competitive $10,000.00 prize main event at World Championships 2017.

Cow Corner Cup shall mean: shall mean:The social, event held during the World Championships 2017.

World Championships Qualification Event/Cow Corner Cup Qualification Eventshall mean: an Open event

World Championships 2017: The Last Man Stands World Championships taking place in Cape Town in December 2017 and the associated main event and cow corner cup event.
